The hero of the drama

       Mr. Adam Kierczyński is a key character of this drama. He was born in Cracov, on
23 December 1956 and his Cracovian heritage plays a significant role. Mr. Adam became a first Polish businessman in the history who got a chance to teach post-communistic Poland how to comply with the law. According to a popular joke in Chicago Cracovians are Scottish mountaineers who were expelled from Scotland for their avarice. Polish-Americans born in Cracov are well known as guys, who really carefully can count money. Mr. Adam after many years spent in the U.S. could not understand how can anyone charge his account several times for the same work? The unfair company made out three invoices with the same number 23/2002 and three different sums of money. May be that Mr. Adam lived in The United States of America too long, and he didn’t feel like business in post-communistic country goes on…  


Once you became a victim of postcommunism, collect good records!

Mr. Adam was a very meticulous man, he collected documents relevant to his investment and all of the records of proceedings in the case. He has got an impressive archive full of all the documents, copies of the files. The case was deliberately delayed and transferred from one public prosecutor's office to another until it became a subject of prescription.

Mr. Adam prosecuted councellor who proclaimed his death, the unfair comapny and the court executive officer, who did not check if his death certificate really exists. He collected all the letters sent and received, all the records of meetings and hearings, all absurd decisions, discontinuances of legal proceedings - literally everything! The entire archive - over 5,000 pages of documents, has been deposited with a trusted American lawyer. Mr. Adam delegated his authority to attorney to continue the case. If something wrong occurred to him, his heirs could obtain a compensation. Mr. Adam says: "Once I became a victim of postcommunist violations of law and postcommunist clique, I started collecting good records”. If you can not defend yourself from criminals, at least provide evidence documenting their crimes. That seems to be a good idea… Soon you may find out that precision and accuracy pay off.


The exact man

When Mr. Adam came first to the editor, his case instantly interested Rafal Klimuszko. Mr Adam with his long moustache resembled Jozef Pilsudski. His grandfather Bronislaw, was a taxi driver in Cracow. In 1945, shortly after the Soviet occupation of Cracow the Red Army confiscated the car. Mr. Adam’s father – Artur, was hired as a regular driver but soon he opened a small freight transport company. In 1984 Mr. Adam managed to get a visa to the U.S. At that time he was 28 years old and he had different part-time jobs. He learned English really quick and got a driver’s license so he could work as a truck driver. After 15 years of residing in the United States he beacame a wealthy man with big savings on the bank account. Mr. Adam became interested in the proposals of Polish Prime Minister, Jerzy Buzek, who convinced the Poles from abroad to invest in Poland. He wanted to ensure a stable life for himself and his family.

In 1999, looking through the real estate deals proposed by the State Agricultural Agency, he found a plot of 13.2 hectares adjacent to the national road A-2 linking Paris, Berlin, Warsaw, Minsk and Moscow. In addition no one was interested in buying this piece of land. Mr. Adam immediately booked a ticket, flew to Poland and 13.2 ha plot in the Lubrza commune became his property.

 You can not lose on such investment

Design Studio “Plan" from Zielona Gora made a really beautiful architectural design. Mr. Adam started building his dream project – a gas station with a restaurant, shop, car wash, sanitary facilities for the truck drivers and a parking lot. Mr. Adam was a truck driver so he knew how to satisfy the needs of his future customers. He built his own shot of water (well), transformed electricity line. The project included the construction of an appropriate entry and the exit from the gas station and the entire facility. All that in accordance with law required building two lanes for the route of the international status.

The entire investment was valued at around 2.5 million dollars but the Polish entrepreneur was aware thet he can not simply lose on such investment! The bank which Mr. Adam chose to work with has only one condition. The investor had to build the entry and exit in accordance with the project, which ensured that the investment within half a year will generate profits. Knowing similar investments in that area bankers easily assessed that the facility will have around 6 million zlotys of the annual profit. In addition, the land with no mortgage was already notarial exclusive property of the  investor. Simply a paradise for the bank! The bank told Mr. Adam that the credit is granted and he could pick up the money as soon as he presents a final decision from voivode and the license to use the entry and exit from the national route to his object.

Here comes nomenclature


The investor from Chicago signed a contract with a local road construction company - Infra. It’s formal owner was Ms Maria Regina Bidej and the actual owner was her husband, Władysław Bidej, who was an influential constructor during the communist era.
The agreement was signed on November 7, 2001. The Infra Company was obliged to complete the work on
May 15, 2002, and by the end of 2002 the facility was supposed to be opened.

It turned out that Infra actually built what was not in the project. The constructors did not widen the route enough. So to remain in accordance with the required width of the road they narrowed the area in the middle of the road between the two lanes going in opposite directions. They failed to comply with the terms of the investment. The authorization for the construction used by the unfair company was illegal and immediately set aside as void by the National Highway Surveillance. Władysław Bidej proved to be a man with good connections. General Directorate for National Roads and Highways has issued an opinion that the object was made scandalous, not in accordance with the approved project and poses a threat to road safety so the General Directorate absolutely do not agree on its use. Mr. Bidej got in touch with the Regional Police Command which has issued an opinion that everything was fine and there was no threat to road safety. Earlier opinion of the same Regional Police Command was completely different, but suddenly RPC has approved badly constructed facility and authorized the use of the facility. After that, suddenly General Directorate for National Roads and Highways changed its opinion, and the object “made scandalous and not in accordance with approved project” – had become made O.K. And post-communistic authorities gave their permission to use it… As the result, illegal authorization has become “legal”…
Mr. Adam Kierczyński persistently demanded to perform the work in accordance with the approved project. The man who lived in
America for such a long time could no longer understand post-communistic so called “democracy” and so he began fight for justice in the courts of so called “the Third Republic of Poland”… By the way, Poles call their nowadays country PRL-Bis, what means Peoples Republic of Poland – the continuation… Peoples Republic was the name of the country during former communistic regime. They also use the name “UBEKISTAN” – UB was the communistic secret police.
